It is ProSync's policy to respect your privacy regarding any information we may collect while operating our application and website (“App”). This Privacy Policy applies to Everest Technology Ventures, LLC’s ProSync mobile application (hereinafter, "us", "we", or "ProSync"). We respect your privacy and are committed to protecting personally identifiable information you may provide us through the App. We have adopted this privacy policy ("Privacy Policy") to explain what information may be collected on our App, how we use this information, and under what circumstances we may disclose the information to third parties. This Privacy Policy applies only to information we collect through the App and does not apply to our collection of information from other sources.

This Privacy Policy, together with the Terms and Conditions, set forth the general rules and policies governing your use of our App. Depending on your activities when visiting our App, you may be required to agree to additional terms and conditions. The Terms and Conditions are incorporated within by reference.

App Users

Like most App operators, ProSync may collect non-personally-identifying information including characteristics of a device, including device ID, the browser type, language preference, referring site, username from stored cookies, and the date and time of each visitor request. ProSync's purpose in collecting non-personally identifying information is to better understand how ProSync's visitors use its App. From time to time, ProSync may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its App.

 

ProSync also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. ProSync only discloses logged in user IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

You may also choose to create a profile using a different credential like Facebook or Google. If you choose to do so, we may ask permission to access basic information from that account, like your name, contact information, profile picture and friend list. You can stop sharing that information with us at any time by removing  access to that account.

 

Personal Information: This refers to information that lets us know the specifics of who you are. You are not required to provide us with any Personal Information to access the App. However, if you wish to use certain features of the App you must provide us with your  email address and password, and/or phone number for account registration.. You agree that we may collect any Personal Information voluntarily supplied by you, whether or not we have requested it. You must not submit any Personal Information relating to a private individual without obtaining their consent. We do not knowingly collect any information relating to private individuals which you do not have permission to provide. Please be aware that without providing any Personal Information, you will not be able to sign up for an account or make any purchases. When you engage in certain activities on our App, such as sending us an email to contact@Prosync.app or utilizing any pages with information or links to contact us, we will ask you to provide certain Personal Information.

We do not collect any types of Sensitive Data from our users. Sensitive Data includes any Personal Information pertaining to: race or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic or biometric data, health or mortality, and sex life or sexual orientation. Please immediately notify us if you have accidentally submitted any Sensitive Data and we shall promptly remove such information.

Gathering of Personally-Identifying Information

Certain visitors to ProSync's Apps choose to interact with ProSync in ways that require ProSync to gather personally-identifying information. The amount and type of information that ProSync gathers depends on the nature of the interaction. For example, we ask visitors who sign up to provide comments, obtain a personal library, ask questions, or give answers to provide a username and email address or phone number.  If you post a video or create a Target Motion of yourself, you may be able to be identified by others.  You should select a username that does not allow you to be identified, unless you wish to be identified. 

 

Security

 

We make extensive efforts to secure your Personal Information. Your Personal Information and Aggregate Information may be stored in perpetuity in our internal database, unless we receive a request by you to remove such information. All Personal Information is stored in the United States, so if you provide us with Personal Information while you are located outside of the United States, it will be transferred to and stored in the United States. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your Personal Information.

For example:

We work hard to ensure that the data we collect is reliable, accurate, complete and current. We use Personal Information only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements. We limit access to Personal Information only to specific employees, Service Partners, contractors and agents who have a reasonable need to come into contact with your information.

Our secure servers are protected by encryption, and our servers reside behind firewalls and password protection. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through the App cannot be guaranteed.

Links To External Websites

Our App may contain links to external sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy and terms and conditions of every site you visit.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party websites, mobile applications, products or services.

Third Party Analytics

We use Google Analytics to evaluate usage of our App. We also may use other analytic means to evaluate our App. We use these tools to help us improve our App, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

 

How We Collect and Use Information

We do not collect any Personal Information about you unless you voluntarily provide it to us. However, you may be required to provide certain Personal Information to us when you elect to use certain services available on the App.

 

We will primarily use your Personal Information to provide information for you. We will also use certain forms of Personal Information to enhance the operation of our App, improve our internal marketing and promotional efforts, statistically analyze App use, improve our service, and customize the App’s content, layout, and services. We may use Personal Information to deliver information to you, and to contact you if you request that we do so. Finally, we may use your Personal Information to enforce our agreements with you, including our App’s Terms and Conditions and this Privacy Policy.

 

We may also share your Aggregate Information and Personal Information as follows:

1. Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.

2. In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

3. To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Privacy Policy, or as evidence in litigation in which we are involved.

4. Aggregate and De-Identified Information. We may share aggregate or de-identified information about users with third parties for marketing, advertising, research or similar purposes. 

 

Release of Information

 

We will not sell, trade, or rent your Personal Information to others. In the future, we may provide some of our services through contractual arrangements made with affiliates, service providers, partners and other third parties ("Service Partners"). We and our Service Partners may need to use some Personal Information in order to perform tasks between our respective sites, or to deliver services to you.

 

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Any other sites accessible through our App, including those of our Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each site's privacy policy. We are not responsible for the policies or practices of third parties.

 

Other than our Service Partners, we do not allow third parties to collect Personal Information or Aggregate Information about you or your online activities when you use our App.

 

Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities. In such cases, we will disclose Personal Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

Cookies

 

To enrich and perfect your experience, ProSync may use "Cookies", similar technologies and services provided by others to display personalized content, appropriate advertising and store your preferences on your device.

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our App, while others are used to enable a faster log-in process or to allow us to track your activities at our App and Service. There are two types of cookies: session and persistent cookies.

1. Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the App. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our App.

2. Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our App who disable cookies will be able to browse certain areas of the App, but some features may not function. 

3. Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies.

In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Website, App and Services to, among other things, track the activities of Website visitors and App users, help us manage content, and compile statistics about Website and App usage. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

 

Updating and Correcting Information

 

We believe you should have the ability to access and edit the Personal Information that you have provided to us. You may change any of your Personal Information in your account online at any time by e-mailing us at contact@Prosync.app. We encourage you to promptly update your Personal Information if it changes. You may ask to have the information on your account deleted or removed; however, some information, such as past transactions, logs of technical support calls, or other information may not be deleted. In addition, it may be impossible to completely delete your information without some residual information because of backups.

Your California Privacy Rights

Upon your request, California Civil Code Section 1798.83, known as the “Shine the Light” law, requires us to provide to you (a) a list of your personal information, if any, which we have disclosed to third parties for direct marketing purposes in the preceding calendar year, and (b) the names and addresses of those third parties. You may make such a request once per calendar year, and we will provide the information to you free of charge. Please send any requests made pursuant to this section to us by e-mail by at contact@Prosync.app information with third parties for their direct marketing purposes.

International Data Transfer

ProSync is a United States company. If you are located outside the United States and choose to provide information to us, ProSync transfers and stores personal information to the United States for processing. The U.S. may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to the U.S., we will protect it as described in this Privacy Policy. By visiting the App, or providing ProSync with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our App; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features in an effort to prevent loss, theft and unauthorized access, use and disclosure.

CAN SPAM Act and Opting Out of Emails

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address in order to:

• Send information, respond to inquiries, and/or other requests or questions.

• We may also send you additional information related to your purchases.

• Market to our mailing list or continue to send emails to our clients after the original transaction has occurred

 

To be in accordance with CANSPAM we agree to the following:

• NOT use false, or misleading subjects or email addresses

• Identify the message as an advertisement in some reasonable way

• Include the physical address of our business or site headquarters

• Monitor third party email marketing services for compliance, if one is used.

• Honor opt-out/unsubscribe requests quickly

• Allow users to unsubscribe by using the link at the bottom of each email

 

We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your any purchases or requests you have made or received from us.

 

Privacy Policy Changes

Although most changes are likely to be minor, ProSync may change its Privacy Policy from time to time, and in ProSync's sole discretion. We will notify you about significant changes in the way we treat personal information by updating any privacy information on this page.

Your continued use of the App after such modifications will constitute your:

1.  acknowledgment of the modified Privacy Policy; and

2.  your agreement to abide and be bound by that Privacy Policy.

User Content

You should also be aware that when Personal Information is voluntarily disclosed (i.e. your name, email address, etc.) by you in the comments you post on the App or in other public areas on the App, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages (including unwanted spam messages) from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information. Please consult our Terms of Use for policies regarding user-provided information.
